Seller Resources/Seller Disclosures
Your Seller Disclosures
Disclose it, and protect yourself.
Arizona law requires sellers to disclose known material facts about their home: anything that could affect its value or a buyer’s decision. Full disclosure protects you, because issues disclosed up front rarely become disputes later.
What You’ll Provide
| Disclosure | When |
|---|---|
| Seller’s Property Disclosure Statement (SPDS) | Within 3 days after acceptance; often shared at listing |
| Insurance claims history (5 years) | Within 5 days after acceptance |
| Lead-based paint disclosure | Homes built before 1978 |
| HOA information | Page 1 of the HOA Addendum, at listing |
| Water Well Addendum | Homes served by a well, within 3 days |
| Septic inspection report | Homes with septic, usually within 20 days |
| Affidavit of Disclosure | Certain unincorporated land, within 5 days |
| Solar documents | Leased or financed systems, within 3 days |

What Arizona Doesn’t Require You to Disclose
Under A.R.S. § 32-2156, sellers aren’t liable for not disclosing that the home was the site of a natural death, suicide, homicide or other felony; was occupied by someone with HIV/AIDS or another disease not spread through occupancy; or is near a registered sex offender. Never make a false statement in response to a direct question.
