Arizona Septic System Addendum

Seller Resources/Seller Disclosures

Septic Addendum

Selling a home with a septic system.

If your home has a septic or other on-site wastewater system, Arizona requires an inspection before ownership transfers. The On-Site Wastewater Treatment Facility Addendum sets the timeline and who pays for what.

Your Responsibilities

01InspectionAt your expense, by a qualified inspector, within 6 months before closing and no later than 20 days after acceptance.
02PumpingA septic tank is pumped at your expense before closing, unless an exception applies.
03DocumentsWithin 20 days, deliver the Report of Inspection and any permit or maintenance records you have.
04RepairsIf the system is “Not Functional,” you pay repairs up to 1% of the price or an agreed amount.

If Repairs Cost More

Above your repair limit

The buyer may cancel, or you may cancel unless the buyer agrees in writing to pay the difference.

“Functional with concerns”

You and the buyer may negotiate repairs or improvements, but neither of you is required to.

Buyer’s Review & Transfer

Buyer reviewThe buyer may cancel within their inspection period or 5 days after receiving the septic documents, whichever is later.
Notice of TransferThe buyer delivers the ADEQ Notice of Transfer form to escrow, which files it at closing.
Filing feeThe addendum says whether you, the buyer, or both of you pay the fee.

Tips for Sellers

  • Schedule the inspection early, since qualified inspectors book up
  • Locate the tank and expose the access lids before the inspection
  • Gather pumping and service records
  • Avoid heavy water use right before the inspection
