Buyer Resources/Contracts & Addenda
HOA Addendum
Buying in a community with an HOA.
Most Arizona neighborhoods and condos have a homeowners association. The H.O.A. Condominium / Planned Community Addendum shows the association’s dues and fees up front, sets who pays which fees at closing, and starts your review of the HOA’s documents.
How the Addendum Works
Fees Payable at Close of Escrow
Documents You’ll Receive
- Current bylaws, rules, recorded declaration (CC&Rs) and plat
- Minutes from the board’s last three open meetings
- A dated statement of dues, special assessments, unpaid amounts and any violations on the home
- The current budget, latest financial statement, audit or review, and reserve study
- A summary of pending lawsuits involving the association
Timing: in associations with fewer than 50 units, the seller provides the information within 10 days of acceptance. In larger associations, escrow notifies the HOA within 5 days and the HOA has 10 days to provide it.
Good to Know
Any HOA assessment that is a lien as of closing is paid in full by the seller; assessments that become a lien after closing are the buyer’s. Fee amounts can change once the association provides its official disclosure, so we confirm them during escrow. In a financed purchase, you pay any lender fees to obtain HOA documents.
