Lead-Based Paint Disclosure for Rentals

Federal law requires landlords of most housing built before 1978 to disclose known lead-based paint information before a tenant is bound by a lease. Many Valley rentals, especially in central Phoenix, Tempe and Mesa, were built in this era.

How the Disclosure Works

01PamphletGive the tenant the EPA pamphlet before the lease is signed.
02DiscloseShare known lead information and any reports or records.
03AttachAttach the signed disclosure to the lease, or include it in the lease.
04KeepLandlords and agents keep copies for 3 years from the lease start.

Responsibilities

For Landlords

  • Disclose before the lease is signed, including at renewal if you have new lead information.
  • Share every report or record you have, including common-area reports in multi-unit buildings.
  • Use certified renovators. Paid work that disturbs more than 6 sq ft inside or 20 sq ft outside, or replaces windows, requires an EPA RRP-certified firm.
  • Keep copies of the signed disclosure for at least three years.

For Tenants

  • Read the pamphlet before you sign the lease.
  • Report peeling, chipping or cracked paint to your landlord in writing right away.
  • Keep dust down by wet-mopping floors, wiping windowsills, and washing children’s hands and toys often.
  • Children under 6 or pregnant? Ask your doctor about a blood lead test.

Exempt Rentals

  • Leases of 100 days or less, such as vacation and short-term rentals
  • Zero-bedroom units, such as studios, efficiencies, lofts and dormitories
  • Housing for the elderly or people with disabilities, unless a child under 6 lives or is expected to live there
  • Housing tested and certified free of lead-based paint by a certified inspector

Why It Matters

Lead dust is the main hazardPaint in good condition usually isn’t a hazard, but chipping paint, friction surfaces like windows, and renovation create dust.
Young children are most at riskLead can affect learning and behavior, and can harm babies before birth.
Penalties are seriousSellers, landlords and agents who fail to disclose can face civil and criminal penalties and can be sued for triple damages.
Arizona’s habitability dutyArizona law requires landlords to keep rentals fit and habitable, so repair peeling paint promptly using lead-safe practices.
