Lead-Based Paint Disclosure for Rentals
Federal law requires landlords of most housing built before 1978 to disclose known lead-based paint information before a tenant is bound by a lease. Many Valley rentals, especially in central Phoenix, Tempe and Mesa, were built in this era.
How the Disclosure Works
Responsibilities
For Landlords
- Disclose before the lease is signed, including at renewal if you have new lead information.
- Share every report or record you have, including common-area reports in multi-unit buildings.
- Use certified renovators. Paid work that disturbs more than 6 sq ft inside or 20 sq ft outside, or replaces windows, requires an EPA RRP-certified firm.
- Keep copies of the signed disclosure for at least three years.
For Tenants
- Read the pamphlet before you sign the lease.
- Report peeling, chipping or cracked paint to your landlord in writing right away.
- Keep dust down by wet-mopping floors, wiping windowsills, and washing children’s hands and toys often.
- Children under 6 or pregnant? Ask your doctor about a blood lead test.
Exempt Rentals
- Leases of 100 days or less, such as vacation and short-term rentals
- Zero-bedroom units, such as studios, efficiencies, lofts and dormitories
- Housing for the elderly or people with disabilities, unless a child under 6 lives or is expected to live there
- Housing tested and certified free of lead-based paint by a certified inspector
